These terms are an agreement between TalkingSuites (“we”, “us”) and you — the person who creates an account, and the organization you act for when you create or use an organization on TalkingSuites. By creating an account or using the service, you agree to them. If you are agreeing on behalf of an organization, you confirm that you are allowed to bind it.
If you have signed a separate agreement with us — an Enterprise contract, for example — that agreement takes precedence where it differs from these terms.
1. The service
TalkingSuites is a platform for building, deploying and operating software: servers in our locations, containers and stacks, databases, object storage, secrets, workspaces connected to GitHub, a marketplace, systems that publish their tools, and the logs, usage and audit records around them.
Early access. TalkingSuites is in early access: we open it to organizations over time, and the service is still growing. This website describes the whole platform; what your organization can use is what the app shows you, and parts of the platform reach organizations at different times. We do not promise when a particular part will reach you. We improve the service continually and may change or retire parts of it; if we remove something you depend on, we will give you reasonable notice when we can.
2. Accounts and organizations
You need an account to use the app, and you must give us accurate information. Keep your sign-in methods secure — your password, passkeys, authenticator and recovery codes — and tell us if you believe your account has been used without your permission. You are responsible for what happens under your account.
An organization has members with roles. Its owners decide who may join and what each person may do, and are responsible for their organization’s members, settings and use of the service. An organization’s ownership can be transferred to another member.
You must be at least 18, and able to enter into a contract, to use TalkingSuites.
3. Your content
“Your content” is everything you and your organization put on TalkingSuites: code, images, configurations, data in databases and buckets, secrets, files and messages. You own your content. You give us the right to host, copy, process and transmit it only as needed to provide the service to you and to keep it secure, and for no other purpose.
You are responsible for your content and for having the rights to use it — including the licences of the software you deploy. You are also responsible for backing up the data that matters to you: the platform gives you the tools to do so — backups, snapshots, dumps into your own buckets — but we cannot restore data that was never backed up.
4. Acceptable use
You must use TalkingSuites lawfully and in line with our acceptable use policy. We may suspend a resource, or an account, that breaks it — usually after telling you and giving you a chance to fix the problem, and immediately if it is causing serious harm.
5. Third-party software and services
Much of what you can run comes from others: the applications and databases in the Marketplace, public images from Docker Hub and other registries, servers from the MCP registry, and your own dependencies. They are provided under their own licences, which the listings name where they can, and they are not ours. We check our own listings before we publish them, but we do not guarantee third-party software, and your use of it is between you and its authors.
When you connect a third-party service — GitHub, for example — your use of it is also governed by that service’s terms.
6. Fees and billing
Plans. The Free plan costs nothing; Enterprise is a contract agreed with us. Plans differ in their limits and features, as shown on our pricing page.
Usage. You pay for what your organization runs. Each resource’s price is shown in the app before you create it. Recurring resources, such as servers, are quoted per month and charged for the hours they exist, never more than the monthly price in a month; metered resources, such as object storage, are charged for what is measured. A resource keeps the price it was created at; price changes apply to what is created afterwards. We will give you notice of any change to the prices of resources you already run.
Invoices and payment. You receive one invoice per organization per calendar month. Unless you pay by invoice under an Enterprise agreement, the invoice is charged to the card you saved, through our payment processor, Stripe. If a payment fails we will try your other saved cards and try again over the following days; if an invoice is still unpaid 7 days after the first attempt, your organization is restricted — it can read everything but cannot create anything — until it is paid. If an amount remains unpaid, we may suspend the service after notice.
AI credits. AI features are paid for with prepaid credits. Credits you buy do not expire. Credits are not refundable or exchangeable for cash, except where the law requires otherwise. Welcome and promotional credits have no cash value.
Taxes. Prices exclude taxes. Where tax applies, it is added to your invoice.
7. Security and confidentiality
We protect the service and your content with the measures described on our security page, and we keep your content and confidential information confidential. Our staff access your organization only to provide the service, to support you or to meet our legal obligations; such actions are recorded in your organization’s audit log.
How we handle personal data is described in our privacy policy and, for personal data within your content, in our data processing terms.
8. Ending the agreement
You can stop using TalkingSuites at any time: delete your resources, your organization or your account from the app. Billing for a resource stops when it is deleted; what was used during the month is still invoiced.
We can suspend or end your use of the service if you seriously or repeatedly break these terms, do not pay, or if we must by law — and we will tell you why unless the law prevents it.
When an organization is deleted it can be restored for 7 days. After that, its servers, buckets, secrets and everything they held are destroyed and cannot be recovered. Move out anything you want to keep before deleting.
9. Warranties
We work hard to keep TalkingSuites running and your data safe, and we describe honestly what it does. But the service is provided “as is”: to the extent the law allows, we make no other promises — including that it will be uninterrupted or error-free, or fit for a particular purpose — except those in a separate agreement you have signed with us.
10. Liability
To the extent the law allows, neither of us is liable to the other for indirect or consequential losses, lost profits or lost data that could have been prevented by backups, and each party’s total liability under these terms is limited to the amounts paid to us for the service in the twelve months before the event that gave rise to the claim. Nothing in these terms limits liability that the law does not allow to be limited.
11. Indemnity
You will defend and compensate us against claims by third parties arising from your content or from your use of the service in breach of these terms or the law.
12. Changes to these terms
We may update these terms. We will post the new version here with its date and, for changes that matter, tell account holders by email before they take effect. If you continue to use the service after that, the new terms apply; if you do not agree, you can stop using it.
13. General
These terms are the whole agreement between us about the service, unless we have signed another. If a part of them cannot be enforced, the rest still applies. Not enforcing a right is not giving it up. You may not transfer this agreement without our consent; we may transfer it to a successor of our business. These terms are governed by the laws of the place where TalkingSuites is established, and its courts have jurisdiction, unless the law where you live gives you rights that cannot be taken away.
